• "Client" or "You" refers to the individual or entity accessing the website or purchasing our services.
• "Third-Party Partners" refers to external licensed professionals (such as legal draftsmen, notary publics, or government entities) with whom we coordinate to fulfill your request.

3. Nature of Services (Important Disclaimer)

3.1. Administrative & Liaison Role

Smartwills.ae provides administrative assistance and liaison services to facilitate the registration of Wills and asset protection structures in the UAE. We act as an intermediary to streamline the process between you, legal professionals, and government authorities.

By using our Services, you agree to:

• Provide accurate, current, and complete information as required for the preparation of your documents.
• Review all drafts and documents provided to you for accuracy before final submission or notarization.
• Ensure you have the legal capacity (are of the age of majority) to enter into a contract and register a Will in the UAE.

We are not responsible for any delays or rejections caused by incorrect or incomplete information provided by you.

5. Third-Party Services

To complete your request, strictly necessary data is shared with Third-Party Partners (as detailed in our Privacy Policy).

• We exercise due diligence in selecting our partners; however, we do not directly control their operations.
• Any fees payable directly to government bodies or third-party courts are subject to the terms and conditions of those respective entities.

6. Payments and Refunds

6.1. Fees

All fees for our services will be quoted to you clearly before the commencement of work. Fees are quoted in AED (United Arab Emirates Dirhams).

6.2. Refund Policy

Due to the customized nature of our services:

• Before Work Commences: If you cancel before we have started drafting or processing your application, you may be eligible for a full or partial refund, subject to a processing fee.
• After Work Commences: Once the drafting process has begun or an appointment with a government entity has been booked, our professional fees are non-refundable.
• Government fees paid on your behalf are non-refundable once processed.

7. Limitation of Liability

To the fullest extent permitted by UAE law:

• Mardef Consulting - FZCO shall not be liable for any indirect, incidental, or consequential damages arising out of your use of our services.
• Our total liability to you for any claim arising out of our services is limited to the amount you paid to us for the specific service from which the claim arose.
• We are not liable for changes in UAE law or regulations that may occur after your service has been completed.
